  • Gun Rights Restored for Fourth Degree Possession Conviction

    Charge(s):

    Kelly’s client was convicted of Felony Fourth Degree Controlled Substance Crime after he sold mushrooms to an undercover police officer. The conviction was later dropped to a misdemeanor, but it resulted in the loss of the client’s firearm rights. The client had no further involvement with law enforcement. He graduated from college, built his own company, started a family, and became an upstanding member of his community. Kelly demonstrated his rehabilitation to the Court, petitioning for his firearm rights to be restored. After presenting background information to the prosecutor, they agreed not to object to the client's petition. Thus, at the hearing, the Court restored the client's gun rights. He can now move on from this offense and return to his family tradition of hunting.

  • Gun Rights Restored for Juvenile Theft of Motor Vehicle Conviction

    Charge(s):

    When he was just 15 years old, Kelly’s client borrowed his friend’s mother’s car without her permission. When he got in an accident in the car, the mother reported it stolen. Kelly’s client was charged with Felony Theft of a Motor Vehicle, and was later adjudicated delinquent of this offense. At the time, Kelly’s client did not understand that this adjudication would result in the loss of his firearm rights, finding out nearly 20 years later when he was denied a permit to carry. Shocked, he sought Kelly’s help. Kelly presented to the prosecutor and Court a strong case, demonstrating that her client was a veteran, a union man, and a father who posed no safety risk to the public. The Court agreed, granting the client’s petition without a hearing, and the client’s gun rights were restored.

  • Kelly Expunges Theft Conviction

    Charge(s):

    When Kelly’s client walked out of a grocery store with less than $40.00 of goods, he was charged with, and later convicted of, Misdemeanor Theft. The conviction had significant consequences on his life, preventing him from being able to find stable work and housing. After reviewing the case and putting together a strong argument for her client’s rehabilitation, Kelly convinced the prosecutor to agree to an expungement. Having successfully done so, Kelly was able to request an expungement order without a hearing. The expungement was promptly granted, and Kelly’s client can now seek better opportunities for his future.

  • Kelly Restores Gun Rights and then Seals Record

    Charge(s):

    Ten years earlier, Kelly’s client was convicted of Felony Fifth Degree Sale (Marijuana) and Felony Fifth Degree Possession (Ecstasy). Both charges were later dropped down to misdemeanors, but they had drastic impacts on the client’s life, causing him to lose his gun rights and consistently holding him back from employment opportunities. Kelly sought solutions to both problems, petitioning the court both for a restoration of his firearm rights and for an expungement. After presenting a strong case for how her client had rehabilitated and was not a threat, the client’s gun rights were restored and then his expungement was granted. The client can now move forward with his life without these offenses hanging over him.
