When a childcare worker reacted to a young child choking and accidentally caused bruising on the child, an investigation was initiated. The client faced potential charges of Gross Misdemeanor Malicious Punishment of a Child and Misdemeanor Fifth Degree Assault. Kelly Keegan contacted the investigator and prosecutors reviewing the case, convincing them that this was an unfortunate result of an emergency incident and that they should not prosecute her client. The Olmsted County Attorney’s Office agreed and did not pursue criminal charges.
