Gun Rights Restored for Juvenile Theft of Motor Vehicle Conviction
When he was just 15 years old, Kelly’s client borrowed his friend’s mother’s car without her permission. When he got in an accident in the car, the mother reported it stolen. Kelly’s client was charged with Felony Theft of a Motor Vehicle, and was later adjudicated delinquent of this offense. At the time, Kelly’s client did not understand that this adjudication would result in the loss of his firearm rights, finding out nearly 20 years later when he was denied a permit to carry. Shocked, he sought Kelly’s help. Kelly presented to the prosecutor and Court a strong case, demonstrating that her client was a veteran, a union man, and a father who posed no safety risk to the public. The Court agreed, granting the client’s petition without a hearing, and the client’s gun rights were restored.
