Gun Rights Restored for Fourth Degree Possession Conviction
Kelly’s client was convicted of Felony Fourth Degree Controlled Substance Crime after he sold mushrooms to an undercover police officer. The conviction was later dropped to a misdemeanor, but it resulted in the loss of the client’s firearm rights. The client had no further involvement with law enforcement. He graduated from college, built his own company, started a family, and became an upstanding member of his community. Kelly demonstrated his rehabilitation to the Court, petitioning for his firearm rights to be restored. After presenting background information to the prosecutor, they agreed not to object to the client's petition. Thus, at the hearing, the Court restored the client's gun rights. He can now move on from this offense and return to his family tradition of hunting.
