Kate Gets Drug Possession Case Dismissed
Kate’s client was charged with Gross Misdemeanor Fifth Degree Possession of a Controlled Substance. The police executed a search warrant of the residence that he shared with his roommates. During the search, police found drug paraphernalia and controlled substances. This search was executed two days after Kate’s client was admitted to the hospital for a medical emergency. The State claimed that her client was in constructive possession of the contraband even though he was still in the hospital during the search. Kate was able to present a compelling argument advocating for her client’s innocence by showing he was not exercising dominion and control over the items at the time of the search. Subsequently, the prosecutor dismissed the case.
