Kelly’s client was the victim in a long-term abusive marriage. When she finally decided to stand up for herself and fight back, her husband was able to turn the tables on her when police arrived by telling police she had assaulted him. She was arrested and charged with domestic assault in Ramsey County. She pled guilty the next morning at her bail hearing and was convicted of disorderly conduct. Thankfully, the incident helped Kelly’s client gain the courage to finally leave her husband. Eventually, she retained Kelly to help finally put the incident behind her. Kelly was able to successfully demonstrate the elements of her client’s situation in court and document the abuse that she suffered. The judge not only granted the expungement so that Kelly’s client can finally put the incident and her abusive marriage behind her, but the judge also made a finding that her client was situated to that of a victim, affording her the legal status of being restored to the status she held prior to the arrest.
