Kelly’s client was convicted in Redwood County of Felony Fifth Degree Possession of a Controlled Substance after an officer searched his car and found marijuana. As a result, he was subject to a lifetime loss of firearm rights. Kelly’s client had grown up hunting with his father, uncles and cousins. Over time, he began to miss this activity more and more. His father also wanted him to inherit some heirloom firearms that had been in the family for generations. Kelly argued before the judge that her client was not a safety threat and had rehabilitated. The judge agreed, restoring her client’s gun rights so that he can hunt again and inherit the family firearms.
