Kelly Expunges Records of Client Convicted of Disorderly Conduct
Charge(s):Kelly’s client was the victim in a long-term abusive marriage. When she finally decided to stand up for herself and fight back, her husband was able to turn the tables on her when police arrived by telling police she had assaulted him. She was arrested and charged with domestic assault in Ramsey County. She pled guilty the next morning at her bail hearing and was convicted of disorderly conduct. Thankfully, the incident helped Kelly’s client gain the courage to finally leave her husband. Eventually, she retained Kelly to help finally put the incident behind her. Kelly was able to successfully demonstrate the elements of her client’s situation in court and document the abuse that she suffered. The judge not only granted the expungement so that Kelly’s client can finally put the incident and her abusive marriage behind her, but the judge also made a finding that her client was situated to that of a victim, affording her the legal status of being restored to the status she held prior to the arrest.

Second Amendment Rights Restored for Client Granted Permit to Purchase but Denied Permit to Carry
Charge(s):Kelly’s client came to her confused after having been granted a permit to purchase by the Eagan Police Department but denied a permit to carry by the Dakota County Sheriff. Upon review of his records, Kelly found he had been convicted in Isanti County for Felony Third Degree Possession of a Controlled Substance, leading to a lifetime loss of gun rights, meaning the sheriff’s permit to carry denial was correct. Kelly drafted and filed her client’s restoration documents and argued before the judge that her client had rehabilitated after becoming sober and establishing a successful career. The judge agreed with Kelly, restoring her client’s rights so that he can deer hunt once again and inherit his grandfather’s heirloom firearms.

Kelly Restores Gun Rights of Client Arrested for Murder for Hire of a Police Officer Scheme
Charge(s):Kelly’s client retained her to restore his gun rights so that he can manage his firearm store and weapon-training business. Earlier in life, he had been arrested for a murder-for-hire plot for allegedly attempting to hire a hit man to kill a police officer while her client working as a confidential informant. He ultimately pled guilty to Felony Terroristic Threats, leading to a lifetime ban on possessing firearms. Kelly mounted a vigorous offense to help her client regain his rights, arguing that he had rehabilitated and that there was good cause to restore his rights. She also dug deep to find old records related to the crime to recount the facts and explain her client was young and had not been truly serious about having the officer killed at the time. Despite the strong objections of the prosecutor and the appearance of the law enforcement officer victim and his family in court opposing the restoration, the judge agreed with Kelly and restored her client’s rights so that he may now manage his gun store.

Kelly Restores Client’s Gun Rights so He Can Hunt Again and Inherit Firearms
Charge(s):Kelly’s client was convicted in Redwood County of Felony Fifth Degree Possession of a Controlled Substance after an officer searched his car and found marijuana. As a result, he was subject to a lifetime loss of firearm rights. Kelly’s client had grown up hunting with his father, uncles and cousins. Over time, he began to miss this activity more and more. His father also wanted him to inherit some heirloom firearms that had been in the family for generations. Kelly argued before the judge that her client was not a safety threat and had rehabilitated. The judge agreed, restoring her client’s gun rights so that he can hunt again and inherit the family firearms.

Kelly Restored Client’s Rights After Washington County Sheriff Denies his Permit Application
Charge(s):Kelly’s client came to her after being denied a permit to carry; she had previously restored his nephew’s gun rights so came highly recommended. Kelly’s client was convicted in Dakota County for Felony Fifth Possession of a Controlled Substance but had been told at the time by officials that by pleading to that offense his gun rights would be restored in ten years. This was very important to him as he is an avid outdoorsman and hunting is an important family tradition. Unfortunately, the law changed in the years since, which Kelly’s client discovered upon being denied the permit now years later. Kelly brought his case before the judge and successfully argued that her client had rehabilitated and should not be subject to a lifetime ban on possessing firearms. The judge agreed so that now her client may hunt with his family once again after all this time.
